Orthopaedic Claims

Orthopaedics refers to the musculo-skeletal system, that is bone and muscles in the body.  It is stated that orthopaedic surgeons are 2.5 times more likely to be sued than those in any other part of the medical profession.  Claims arise from the failure to diagnose fractured bones, failure to repair or to set fractured bones properly in a plaster cast, failure to detect dislocation and, following surgery, deep vein thrombosis and pulmonary embolism. 

Orthopaedic surgeons also have been the subject of claims where joint replacements have been adequately undertaken which have left patients with restrictive movement and limps. 

If there has been inadequate treatment, it is then necessary to show that this has affected the outcome in some way, that is - the fact that there was a late diagnosis of a fracture has meant that the bone has not healed correctly or has not healed in alignment. 

Unfortunately fractures are quite often missed and there may be a delay in the x-rays being sent for review which means that the patient is then late being recalled for review at the fracture clinic.
